Overview
These Terms of Service ("Terms") govern your access to and use of the Mobyform website, hosted product, documentation, public forms, and related services. By accessing or using Mobyform, you agree to these Terms.
If you are using Mobyform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Eligibility and Accounts
You must provide accurate information when creating or using an account. You are responsible for:
- maintaining the confidentiality of login credentials
- activities that occur under your account or workspace
- ensuring your users and collaborators comply with these Terms
- using appropriate security controls, including strong passwords and access management
You must promptly notify us if you believe your account or workspace has been compromised.
The Service We Provide
Mobyform provides software and related services for building forms, collecting submissions, collaborating with teams, reviewing data, and accessing related documentation and support resources. The public website is published under mobyform.com, and the hosted product application is currently delivered from build.mobyform.com.
We may update, improve, change, suspend, or discontinue parts of the service from time to time. Some features may depend on your plan, workspace configuration, region, or third-party service availability.
Customer Content and Responsibility
You retain ownership of the content, forms, submissions, files, and other materials you or your users upload to Mobyform ("Customer Content"), subject to the rights necessary for us to operate the service.
You grant Mobyform a non-exclusive, worldwide, limited right to host, process, transmit, store, copy, display, and otherwise use Customer Content solely as necessary to provide, secure, support, and improve the service, and as otherwise permitted by these Terms and applicable law.
You are responsible for Customer Content and for ensuring that you have all necessary rights, notices, and permissions to collect and process any data submitted through your forms. That includes compliance with privacy, employment, consumer protection, marketing, export, accessibility, and other laws that apply to your use case.
Acceptable Use
You may not use Mobyform to:
- violate applicable law or regulation
- infringe intellectual property, privacy, publicity, or other rights
- transmit malware, malicious code, phishing content, or harmful links
- abuse, disrupt, probe, or attempt unauthorized access to the service or other accounts
- send spam, deceptive communications, or unlawful marketing
- collect or process data without an appropriate legal basis or required notice or consent
- use the service in a way that creates security, privacy, fraud, or platform abuse risk for Mobyform or others
We may investigate suspected misuse and take action including restricting access, removing content, suspending accounts, or cooperating with lawful requests.
Fees, Plans, and Billing
Some parts of Mobyform are paid services. If you purchase a paid plan:
- you agree to pay the applicable fees, taxes, and charges
- subscriptions may renew automatically unless canceled in accordance with the applicable plan terms
- plan limits, included features, and usage allowances are determined by the plan you selected
- we may update pricing or plan structure prospectively, subject to applicable notice requirements
- hosted billing and checkout may be processed through Stripe or Creem, and the active payment processor may vary by environment, plan, or billing configuration
- unless required by law, explicitly approved by us in writing, or stated otherwise in an order form or separate agreement, fees are non-refundable
- if you cancel a recurring plan, the cancellation ordinarily stops future renewals; unless a plan, order form, or separate agreement says otherwise, access typically continues until the end of the current paid term
Where payment processing is handled by a third party, that provider's terms and privacy practices also apply. If you have a separate order form, enterprise agreement, or written commercial addendum with Mobyform, that document controls to the extent it expressly conflicts with these default billing terms.
Intellectual Property
Mobyform and its associated software, design, branding, documentation, and other materials are protected by copyright, trademark, trade secret, and other laws. Except for the limited rights expressly granted in these Terms, Mobyform retains all rights, title, and interest in the service and related intellectual property.
Feedback you provide about the service may be used by Mobyform without restriction or compensation.
Third-Party Services
The service may integrate with or link to third-party platforms, payment providers, analytics tools, identity providers, storage providers, and other external services. Mobyform is not responsible for third-party services, and your use of them may be subject to separate terms and policies.
Suspension and Termination
We may suspend or terminate access to the service, in whole or in part, if:
- you violate these Terms
- your use creates legal, security, or operational risk
- payment obligations are overdue
- we are required to do so by law or to protect the service, customers, or the public
You may stop using the service at any time. Termination does not relieve you of obligations incurred before termination, including payment obligations and responsibilities relating to unlawful or unauthorized use.
Disclaimers
To the maximum extent permitted by law, the service is provided on an "as is" and "as available" basis. Mobyform does not warrant that the service will be uninterrupted, error-free, secure, or suitable for every use case, jurisdiction, or compliance requirement.
You are responsible for evaluating whether the service, configuration, legal notices, and operational controls you use are appropriate for your business and regulatory environment.
Limitation of Liability
To the maximum extent permitted by law, Mobyform will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity arising out of or related to the service or these Terms.
Where liability cannot be excluded, Mobyform's total liability for claims arising out of or related to the service will be limited to the amount paid by you to Mobyform for the relevant paid service during the period reasonably related to the claim, subject to the minimum rights you may have under applicable law.
Indemnity
You agree to defend, indemnify, and hold harmless Mobyform and its affiliates, officers, employees, and agents from claims, liabilities, damages, losses, and expenses arising out of or related to:
- your use of the service
- your Customer Content
- your violation of these Terms
- your violation of applicable law or third-party rights
Changes to These Terms
We may update these Terms from time to time. If we make a material change, we may provide notice through the website, product, or other reasonable means. Your continued use of the service after the updated Terms become effective means you accept the revised Terms.
